Judge William F. Coleman approved a motion filed by Dave Ware's attorneys calling for a special election in the Hattiesburg mayoral race.

Attorneys for Mayor Johnny DuPree filed an opposing motion later yesterday, calling for the judge to deny Ware's motions.

Coleman denied Ware's motion for a reinstatement of the jury's 9-3 verdict, saying the jury was properly polled. The polling of the jury by Coleman resulted in a change in the verdict to 8-4. Coleman said the purpose of polling is to give each juror a chance to voice their individual verdict in open court.

Gov. Phil Bryant will set the date for the special election.
